Provided by IRONMACE. The popular game is no longer available on Steam | Published: Mar 27, 2023 03:17 pm Popular fantasy extraction game Dark and Darker is down due to a copyright claim from gaming company Nexon. This claim happened just before another playtest for Dark and Darker went live. For fans unfamiliar with Nexon, they are a Japanese and South Korean publisher known for games such as Maple Story. After this claim went through, local police went through IRONMACE’s office and their game was removed off Steam. Dark and Darker faces DMCA takedown As revealed on the Dark and Darker Discord, this DMCA takedown was based off of “distorted claims” according to IRONMACE. The claim stated that IRONMACE used both code and assets from Nexon in development of Dark and Darker. The angle that Nexon is going for revolves around a failed project known as P3 under development by Nexon. This fantasy dungeon crawler had one of the IRONMACE employees formerly work on it. Then, after moving to IRONMACE, the founder Terence Park knew of this, at least according to Nexon’s claim. Provided by IRONMACE. Recently, on the Dark and Darker Discord, the team at IRONMACE went into a lot of detail for why this claim is false. An over fifteen paragraph explanation is still in the announcements page on the Discord channel. In summary, the three major claims revolve around the former Nexon employee, the founder of IRONMACE knowing of the stolen code and assets and the similarities from P3 and Dark and Darker. Park himself stated his perspective on why each of these claims were wrong. Plus, throughout the post, he mentioned upcoming evidence that will be shown to disprove the claim. A statement to end it off Towards the end of the Discord post, Park included a statement to conclude the news for now. “Given the information presented, it is difficult to believe that Nexon, in good faith, could reasonably believe that Ironmace has infringed on the copyrights for their P3 project,” Park said. “They also provide no actual evidence that Ironmace misappropriated Nexon’s trade secret Nexon meant to hurt Dark and Darker as it gained popularity. Whether Dark and Darker utilized copyrighted materials from Nexon's Project P3 will not be decided in a US court, it seems. Nexon's case has now been dismissed, with the court agreeing with Ironmace that the US was the incorrect jurisdiction for the lawsuit. That doesn't mean that the situation has been remedied, however. Nexon continues its legal efforts against Ironmace in South Korea, which the US court agrees is the correct place for a decision to be made. Both Nexon and Ironmace are based in South Korea. What this means for Dark and Darker in the short term isn't entirely clear. Ironmace appears to be hopeful that it will lead to Dark and Darker returning to Steam, though. A statement from the company mentions that Dark and Darker could return to "US-based gaming platforms" soon. Valve has made no indication whether it will bring Dark and Darker back to Steam now that the lawsuit has been dismissed. Development of Dark and Darker continues to move forward without Steam's support. The first-person fantasy extraction game was recently launched in early access. It can be purchased for $35 through the official Dark and Darker website. The path forward for Ironmace isn't obvious. While there's a good amount of attention surrounding Dark and Darker's early access launch, it likely pales compared to what it could be if Dark and Darker was on Steam. The lawsuit and Valve's decision to de-platform Dark and Darker came at a time when the PC game was seeing viral success. While Dark and Darker remains off of Steam, the dismissal of the lawsuit could open the door to the game's eventual return. But Ironmace's legal troubles may not be over. The court sided with Ironmace as the defendants, and ruled that South Korea would be a more "appropriate" venue for the lawsuit to be heard."We have long maintained that the US lawsuit was a heavy-handed attempt by a much larger game company to overpower its smaller competitor," a statement from Ironmace reads.
