If you think that doesn't count as "copying" for copyright then you are sorely mistaken, indeed courts have previously held that reproducing something in your RAM buffer can constitute a violation of copyright.Do I agree that this is the way the law *should* be? No. But, how the law *should* be is largely irrelevant to the present issue. What is at issue is how the law *is*.(edit: unless, of course, I'm misinformed about how Cockatrice operates which is a possibility)Pretty sure fair use laws covers that. Every time someone looked at any type of art their computer caches a thumbnail, or at least temp stores the data in RAM.Also did they accept "donations"? If they did they might be in some hot water. Further, the argument that Cockatrice violates copyright law is not as easily bested as you might think. I dont think there will be any backlash from discussing alternate servers for cockatrice as long as no money changes hands. It was a copyrighted program that you didn't have the rights to distribute. That breaks the law, even if the program is old and not on sale anymore.The issue with Cockatrice is actually an entirely different thing. From what I understand, the creators allow the program to be distributed freely. What's going on is Wizards is claiming the program violates their copyrights. It's an entirely different situation.
