TULSA, Okla. — Tulsa Animal Services shared their advice after a positive rabies case in a dog was confirmed in Tulsa city limits."So February 14th, a bite incident was reported by a citizen here in Tulsa," said Colton Jones, the Operations Manager for Tulsa Animal Services. "A follow up investigation by our animal control officers into that incident found that the biting animal had been euthanized by its owner and buried outside of the city limits, so we made a request that it be exhumed and brought back to us so that post-bite testing could be done for rabies. In the process of submitting that to the state lab for testing for rabies, we did receive a positive result and at this time we're currently working with the Oklahoma State Department of Health for post-exposure protocols for the people involved and then taking care of any animals that are needing to be taken care of."According to City of Tulsa veterinarian Carolynne Cash, it's quite rare to have a dog test positive for rabies in the state of Oklahoma."Bites are common, but the positive rabies in a dog or cat is not super common. Probably in the whole state—I was talking to the State Health Department yesterday—probably every year between two to five...I think the ratio is kind of like three cats to two dogs basically test positive. 2025-04-01First. Nat. Bank, 169 Okla. 90, 36 P.2d 27. In the instant case it cannot be successfully contended that the plaintiff's petition did not state a cause of action against the defendant. Neither the petition nor the reply contains allegations showing the cause of action barred by the statute of limitations which might present only a question of law to be determined by the court. Neither can it be said that the answer of the defendant fails to set up a defense, which, if proved as alleged, would entitle the defendant to a judgment in its favor. The petition and answer, together with the reply denying allegations of new matters in the petition, have presented controverted questions of fact which could be properly determined only by testimony, and a judgment on the pleadings would have been reversible error. Peck v. First Nat. Bank of Claremore, 50 Okla. 252, 150 P. 1039.¶12 Section 429, O. S. 1931, provides:"Where, upon the statement in the pleadings, one party is entitled by law to judgment in his favor, judgment shall be so rendered by the court, though a verdict has been found against such party."¶13 In Beard v. W. T. Rawleigh Co., 136 Okla. 165, 277 P. 657, this court, following many former decisions of this court, held:"In the absence of special findings, it is error to render judgment notwithstanding the verdict unless the party in whose favor such judgment is rendered is entitled to judgment on the pleadings."¶14 More recent decisions of this

2025-04-17TULSA, Okla. — Tulsa Animal Services shared their advice after a positive rabies case in a dog was confirmed in Tulsa city limits."So February 14th, a bite incident was reported by a citizen here in Tulsa," said Colton Jones, the Operations Manager for Tulsa Animal Services. "A follow up investigation by our animal control officers into that incident found that the biting animal had been euthanized by its owner and buried outside of the city limits, so we made a request that it be exhumed and brought back to us so that post-bite testing could be done for rabies. In the process of submitting that to the state lab for testing for rabies, we did receive a positive result and at this time we're currently working with the Oklahoma State Department of Health for post-exposure protocols for the people involved and then taking care of any animals that are needing to be taken care of."According to City of Tulsa veterinarian Carolynne Cash, it's quite rare to have a dog test positive for rabies in the state of Oklahoma."Bites are common, but the positive rabies in a dog or cat is not super common. Probably in the whole state—I was talking to the State Health Department yesterday—probably every year between two to five...I think the ratio is kind of like three cats to two dogs basically test positive. I think it's been quite a long time since we've had one test positive here in Tulsa city limits if I'm correct."However, both Jones and Cash said you should always report an animal bite to Tulsa Animal Services right away for your safety and the safety of others."If you're bitten, the first thing that we want you to do is to report that animal bite to Tulsa Animal Services," said Jones.
